Terminology
The following terminology applies to these Terms and Conditions, Privacy Policy and any or all Agreements:
“Client”, “You” and “Your” refers to you, the person accessing this website and accepting our company’s Terms and Conditions.
The term “Cosmic Web Design”, “This Company”, “Ourselves”, “We” and “Us”, refers to the owners of the website.
“Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves.
“Third Party”, “Third Parties”, refers to a person or group besides the two primarily involved in a situation. Such as an external company.
Acceptance of quotation
On the acceptance of a quotation the Client agrees to the terms & conditions and privacy policy of Cosmic Web Design.
The quotation will provide the Client with the details of the tasks to be completed as part of the project and will also include the costs of our services.
Any tasks outside of the original quotation will be charged in addition. Cosmic Web Design will quote for any additional work separately. Additional work will be carried out once approved by the Client.
Deadlines
Cosmic Web Design will always work hard to meet agreed deadlines. We cannot be held responsible for events out of our control such as but not limited to receiving content from the Client by the date previously agreed, power cuts and technical issues.
In the event of any delay on behalf of Cosmic Web Design we will inform the Client of the revised deadline date as soon as possible.
Client content
If the Client fails to deliver content for a project by the date agreed Cosmic Web Design reserves the right to cancel the project. Cosmic Web Design will write to the Client via email giving them 30 days notice of cancellation.
Any deposits made by the Client will be non refundable.
Should the client wish to restart the project after the cancellation date, a new revised quotation will be provided and the previously paid deposit will be deducted from the new quotation.
Should you the Client know of any reason why content is going to be delayed beyond the agreed date let us know as soon as possible and we will do our best to accommodate you.
Client review
On completion of a project the Client will be responsible for thoroughly reviewing the content for any errors. The Client will have 14 days after completion to review and request amendments to any content errors. Once the request has been accepted Cosmic Web Design will make the amendments within 14 days of the acceptance (unless this is not possible by no fault of our own).
Should the Client request changes to any content errors after the 14 day review period, this will be charged at an hourly rate.
Domains & hosting
Hosting package will be billed monthly (unless previously agreed).
Domains are billed on a yearly basis. Domains can be purchased over several years in a single transaction.
As some services are provided by carefully selected third parties Cosmic Web Design cannot be held responsible for any loss of earnings or implied loss of earnings by the Client should any part of the service not function correctly. See Liability section for more information.
We reserve the right to delete all files from our servers and storage for non payment. Clients will be notified that their files are to be deleted after 30 days if their outstanding balance is not cleared.
Website maintenance
Our maintenance packages are billed monthly (unless previously agreed). If the Client has taken out of our maintenance package Cosmic Web Design will update all software, themes and plugins which will help to keep the website as secure as possible. In the event a plugin is no longer functional we will do our best to source a replacement plugin for your website and install it.
Maintenance plans protect the Client in the event an update causes issues to the website.
Dependent on the maintenance plan chosen, Cosmic Web Design offers a set amount of hours (stated in the package details) for website amendments each month. If unused, the hours can roll over for a maximum of one month. For example if your package provides you with 2 hours worth of amendments, then any month this is unused you would be allowed 4 hours the next month. Any hours unused after the maximum allowance has been reached will be lost.
If the Client chooses to manage their own website in any way Cosmic Web Design holds no responsibility in the event the website stops functioning correctly. This shall be the Clients responsibility. Should the Client need Cosmic Web Design to restore the website from a previous backup or make any fixes, this additional work will be charged by the hour.
All additional work billed to the client is charged per hour. A minimum of 1 hour will be billed and any additional hours are billed in half hour segments.
Payments
A 50% deposit is required prior to the beginning of any project (unless previously agreed). The remaining 50% must be paid in full before Cosmic Web Design publishes the live website or sends over any design files.
Larger projects may be billed in stages. Should this be the case, billing milestones will be discussed with the Client prior to beginning the project. Each milestone amount must be paid in full before the continuation of the project.
All invoices will be sent via email.
Hosting and maintenance packages are billed monthly.
Upon completion of any additional work our standard payment terms are strictly 30 days. Payment dates will be attached to all invoices sent via email.
We reserve the right to delete all files from our servers and storage for non payment. Clients will be notified that their files are to be deleted after 30 days if their outstanding balance is not cleared. After the 30 days retrieval of files will no longer be possible.
We use third party payment gateways such as but not limited to PayPal. If you choose to use the payment gateway to complete and pay for your order, you will provide your details, directly to third party. The third parties privacy policies will apply to the information you provide. These privacy policies can be found on the third parties website.
Design ownership
All designs work including but not limited to logos, graphics, flyers, business cards, leaflets and banners are owned by Cosmic Web Design and will only become the property of the Client once full payment is received.
Any use of our designs that have not been paid for in full is not permitted (unless previously agreed). Doing so will be a breach of copyright and could lead to legal proceedings.
Once full payment is received by Cosmic Web Design the design files will then be sent to the Client to use, edit or modify should they choose to. The Client will then have full ownership and rights to their artwork.
Printing
Cosmic Web Design will only send orders to print with artwork that has been fully approved by the Client via email.
Although Cosmic Web Design has done prior research to find reliable, high quality printing companies. As printing is done by a third party, Cosmic Web Design cannot be held responsible for the quality of printed materials or any delay out of our control either with the printing company or delivery company.
As prices are subject to change, Cosmic Web Design will only honor a print quotation provided to the Client within the last 30 days. If the Client decides to move forward with an order after 30 days from the original quotation Cosmic Web Design will provide the Client with a new quotation.
Liability
As some of our services are provided by third party suppliers Cosmic Web Design cannot be held responsible for any loss of earnings or implied loss of earnings by the Client should any part of the website not function including but not limited to hosting, content, emails or functionality.
We exclude all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or the Company’s literature; and excludes all liability for damages arising out of or in connection with your use of this website. This includes, but not limited to, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised this Company of the possibility of such potential loss), damage caused to your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.
The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.
Copyright
The Client grants Cosmic Web Design the rights to publish and use any materials provided including but not limited to written content, images, logos and files. The Client must retain the copyright to all materials provided.
The Client is responsible for obtaining prior permission and rights to use and share all materials that are copyrighted by a third party.
Cosmic Web Design shall hold no liability for any breach of copyright for any materials provided by the Client.
When providing any materials the Client acknowledges they must hold the copyrights to all material and hold harmless Cosmic Web Design from any and all claims resulting from the Client’s failure to obtain the proper copyright permissions.
Privacy statement

Your submission of personal information through this website is governed by our Privacy Policy.
You may contact Cosmic Web Design and withdraw your consent for us holding your data by advising us via email.
Termination of agreements
Both the Client and ourselves have the right to terminate any Services Agreement for any reason, including the ending of services that are already underway. No refunds shall be offered, where a Service is deemed to have begun and is, for all intents and purposes, underway. Any monies that have been paid to us which constitute payment in respect of the provision of unused Services, shall be refunded.
If the Client chooses to transfer any partially or fully completed work to a new host or website provider this will be the Clients responsibility. Should the Client require a backup copy of the files for transfer, there is an administration fee of £50.
Links to other websites
Cosmic Web Design may add links to other websites of interest. Should you choose to leave our website through such links, we are no longer in control of any information collected/given. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such websites. You should exercise caution by looking at the privacy and cookie policies applicable to the website in question as they are no longer governed by our policies.
We do not monitor or review the content of other party’s websites which are linked to from this website. Opinions expressed or material appearing on such websites are not necessarily shared or endorsed by us and should not be regarded as the publisher of such opinions or material. Please be aware that we are not responsible for the privacy practices, or content, of these sites.
You should evaluate the security and trustworthiness of any other site connected to this site or accessed through this site yourself, before disclosing any personal information to them. This Company will not accept any responsibility for any loss or damage in whatever manner, howsoever caused, resulting from your disclosure to third parties of personal information.
